IMVHO.
Iggy (and the board) has spent the best part of two years looking around (the globe) to get the final financing deal together.
If you say he got Kfw funding why would you believe that clause will be invoked? Especially as the intial part is showing $1.10 shares begin quoted at $1.60 in the market.
It's fair enough to look a the negatives but if you focus on them you have no go (how about we leave that for the competitors/ alternative HPA wannabes).
