The powers Brierley was searched under have nothing to do with Dutton. I worked in Customs in the mid 1990's and the powers under which Brierley was searched existed then and were commonly exercised. Customs Officers have an absolute right to search property entering or exiting the country. Where that search uncovers an offence the matter is placed in the hands of Federal Police.
