IMO settlement will only be viable if SPX can pay VMC less than or equal to the anticipated legal costs to run the fight, unless SPX has advice (after the parties have exchanged discoverable documents) that they're more likely to lose than win, in which case a larger sum that allows them to retain the asset would be palatable.
Similarly, I can't see too much motivation for VMC to settle unless they've been advised (after the parties have exchanged discoverable documents) that they're not likely to win. But perhaps this whole thing was just a shake down from the start and VMC might walk for a few $m...
One thing's for sure, there's no winners in this mess right now!
