    Nothing wrong with shorting ... just naked shorting. If you borrow the shares and sell them, thats fine. If you can't find the shares to borrow, you can't do it.

    Its easy to stop naked shorting. If you don;t settle in 3 days on any trade, your organisation (even a whole bank) cannot trade 1 more thing until you settle.
