ASX Market Participants were advised on 19 September 2008 of changes to the reporting requirements in respect of their “net covered short positions” as defined in ASIC Class Order 08/751(refer to ASX Circular 466/08). 2. ASX Market Participants were further advised on 22 September 2008 of the continued applicability of the changed reporting requirements to those Market Makers and Warrant Market Makers who are exempt from the prohibition on covered short selling imposed by ASIC Class Order 08/752 (refer to ASX Circular 469/08). 3. ASIC has also advised that it will provide relief to enable persons engaging in arbitrage transactions in relation to the securities of dual listed entities to make covered short sales of the relevant securities in Australia (refer to ASX Circular 470/08). 4. ASX has formalised the changes to the reporting requirements in the ASX Market Rules Procedures (refer to ASX Market Rule Procedures 19.6.1 and 19.6.2). 5. The effective date for the Procedure amendments is 22 September 2008. As noted in the amended Procedures, “net covered short positions” in terms of subsection 1020BC(4) of the Corporations Act 2001 (Cth) must be included in Trading Participants’ net Short Sale position reports from Tuesday 23 September 2008 for positions as at 7.00pm Monday, 22 September 2008. 6.
