They could be in negotiations with YOU for all that matter and still satisfy the rules requiring such an announcement to the market.

IMO, 31st October is either when we find out who the third party is (typically INL will make it on that day) or we find out who is the Administrator giving 5 days notice for a meeting of creditors.

...and if they survive, there's nothing in writing for a full contract anticipated until 2009 q1 when financing will be finalised. Any written agreement by 31st October, strictly reading carefully into the announcement, will surely be 'subject to contract.' Still preliminary stages. They are just buying more time as per usual. Empty promises.
