The costs are based on a notional amount of damages the patent infringement could be worth. The court has set this as 30mill Euro and is a good thing as it sets in my opinion a minimum amount for the worth of the infringement case against DT. My understanding is that the actual damages will be dependant on discovery proceedings as occurred in Australia against Ericson.
