I agree about no smoking gun, but that is what a discovery phase of a class action would produce or not. I am neither for nor against a class action, I haven't given it enough thought.

This is all conjecture at the moment, driven partially by some strong emotions. It's hard for me to believe that what was said was based on well reasoned information, but I could be wrong.
