Yes it is real.
I understand FAR's position is much much worse.......dire in fact.
But
With all their undrawn debt and cash they are still about 300 million short of the required amount.
Their spend for this year is expected at $615 million.
If FAR are technically insolvent aren't CNE also was the point?
CNE will not see a penny from arbitration even if they win IMO. The Indian gov have already said that the countries taxation policies are not part of the treaty.
