Seriously though, based on previous posts you seem to think that if this were the outcome (ie. $220m) then this is a moot point anyway because if those funds became available to the pool then the litigatgion groups would instantly put an injunction on any payouts until they established their M&D case in 5 year time.

I can't believe this is actually what would happen because clients would be lucky to get 20c in 5 years time once everyone has been fed, or 0c if they lose the litigation case.

This is clearly not in their clients best interest and I do not believe that this would be a strategy that would get approval from group member. At least I hope not.

It was my impression that first the perferences would settle (or not), and then if there was reason to continue litigating then it would be a separate matter. Clients would get to keep their liquidation payout in full, while the BO, M&D case was tried in order to seek the real damages being March 27 evaluations, restitution of shares and cash, etc.

Or, am I missing some of your thinking still? (I'm not very knowledgable or smart)

Of course, if ANZ do pay out the Finkelstain-esque 100c then they might start squawking on about wanting to be left alone because they paid everyone out. Who knows.

Again, this is not personal, just tensely exploring all the angles in this information vaccum we are forced to operate in.
