There is I think one complication in the background in relation to the performance shares some of which may be held by JKs BVI entity. It is that JK and his BVI entity are defending a separate legal claim from a former ISX executive / employee in relation to a slice of the performance shares. JK and the company would not in my view be able to cancel those shares if they are subject to a third party claim over some of those shares.
It would have to be the courts, at the request of ASIC to cancel the shares.
Sooo, back to today, have arguments from both sides finished regarding the injunction?
Has the Judge reserved her decision?
When / is there to be a round two?
Where do we go with this?
Does ASIC now need to undertake its own investigation as to the validity of the issue of the shares?
