My legal advice is firmly in the camp of CGR in relation to the MACs (whether or not they have been breached).
What would you take as a revised price to save a drawn-out court battle? 10% less? Anything more I think you call their bluff and take them to Court and compel them to complete.
Would be ironic to see ScotPac banging on ACCC's door suggesting that they should stop the takeover on competition grounds.
