that sounds a bit weak to me Tim. CVI put up 14 mill to purchase part of pensador that was supposed to furnish the funds to develop the CVI assets. that to me sounds like it should be straight forward. Pensador didn't meet their end of the deal for whatever financial crisis reasons so CVI should get their money back. Smyth is a lawyer so surely to god he would have tied all that up first.

If I went to the ANZ to get a loan for a house and they charged me several thousand to set the loan up and then told me after the several thousand was gone that i couldn't have the loan and I couldn't have my setup fee back then I would be removing my bank managers manhood with a blunt instrument......or I would be getting my money back.

It's different for CVI investors though...you invest in a mining spec and may find there is nothing in the ground or that commodity prices collapse.....in that case you lose your money, that's the chance we take. But to tell me that Smyth paid all that money to Pensador to fund the projects and there were no protection measures in place and the funds are not forthcoming and the 14 mill is non refundable ??? ......something is VERY fishy.
