We know FH looking at funding options for the case against ANZ and ML. From what we hear IMF have put their hands up to fund the case. The terms put forward are unknown. Either way they will get their cut from it.
How do we know that FH are considering all options. At some stage the litigation funders would want to undercut their competitors especially in a case like this.
We should request that FH call all interested parties to put together a funding option that will best look after the clients should there be a satisfactory resolution.
After all ANZ may wish to settle outside of court (minus damages). I think they know they are toast on the preference issue.
