I'm a lawyer, although by no means does my practice extend to this area of law. Broadly speaking you can disclaim your way out, but it all depends on the disclaimer and how bad are the side-effects. If you look at over the counter pills, there are always disclaimers about potential side effects and to see a doctor. However, these are mostly for short-term side-effects. For long term side-effects, the situation is different, and will depend upon the level of understanding the person had before taking the medication, the extent and detail of the side-effects provided etc.
In short, you can and you cannot, and there are a multiple of factors that you need to consider - probably not the most helpful answer but it is a difficult topic and as always, lawyers will always argue the toss no matter what...
