No, the way I read it is that KFE is entitled to take part in any upside as per what I described above on the 38 million shares. It's weird they didn't provide greater clarity on the structure of the deal and what the 18 monthly payments were made up of. I would assume the monthly settlement would be made up of "X" amount of shares times the benchmark price + or - the difference. Assume also the remaining shares were paid to organize the deal.
Could possibly be a great deal for the company if it shoots to moon, i just don't know how many shares they can dump per month.
