I agree he sounded like a tosser from the article. But on the not wanting to settle I would say its got more to do with not feall being able to afford to write a cheque in the current climate than not wanting to.
Lets see if that changes as the liquidators hearings kick off. This will be the one thing that ANZ will be petrified of. A court room full of press who are smelling blood, a liquidator who hasn't been paid able to ask any question he wants (including did your Chairman really say that about the Opes Clients), and "I dont recall" not being an acceptable response.
