Ok, so you are saying they may well have met the official criteria outlined for the issuance of performance shares, but you believe that because this doesn't meet your personal conditions for what you think would justify issuance (net loss, salaries, monthly delivery metrics etc), it should not have happened?

Just not how it works. Everything you have mentioned outside the core metric of "$3.75m in any 3-month period" is irrelevant for the eligibility for issuance.
