Say what? It can take decades to take a patent from approval to a commercial success - and you are worried about 2 years. The company has made it very clear that it is not actively looking to file new patents as it does not want to share its 'secret sauce'. I would assume that current products are built using a combination of current technologies which the company does own the patent for anyway.
I don't know what is currently going on at DRO - but this patent issue you raise is a company strength, not a weakness in my opinion.
