Thanks for the reply Jermaynew and my inclination is to assume that you only have to hold for 45 days as you say.
However, if you are a tax advisor and have access to the Aust Tax Handbook 2003 take a look at the At-risk requirement on page 1012 where it refers to the "primary qualification period" as being 45 days commencing after the day on which the shares become ex-dividend.
