"These shares may be released early from these escrow obligations to the extent required in order to dispose
of up to 33.3% of their escrowed Shares (in one or more transactions) after both the following conditions
have been satisfied:"

May - might or could
Up to - that number or less

So it is still at the holders discretion to sell the shares being released from escrow rather than a definite.
