You are free to believe that shareprice volatility is the reason but the documents are VERY clear. Shareprice volatility I beliebe would inadmissible in court and I think that is why there is no mention of shareprice volatility anywhere in the SOC. Instead we have this:
Well I don't know anything about wrongdoings but they did receive the performance shares. I don't know the amount and I don't know the current status of them. The problem is that I believe it is very likely that the shares may have been sold...
...So if Red 5 and other parties that have received their performance shares have sold theirs then it could be that the total amount of the performance shares that have been sold may amount to more than 50 percent. I don't know...and the ASX is trying to find out...but ISX and you all are not making things easy.
