    Talking about the death penalty for capital offences such as murder of willful murder, we had here in Western Australia the case recently of Andrew Mallard, who, after 13 years in prison after being convicted of the brutal murder of a Mosman Park shop owner, was found to have been innocent of the "crime".

    It was shown during an enquiry that the police, and in turn the prosecution, withheld vital evidence from both the defense and the court that may have, if revealed, led to a not guilty verdict be the jury.

    His release only came after the High Court of Australia ruled that a retrial should take place and the state DPP declined to prosecute the case again.

    Another man, who later committed suicide in Albany prison, become the chief suspect.

    So while we have human beings conducting enquiries, mounting prosecutions and ordinary folk giving their verdict, with all their failings, the death penalty is a very tough thing to support imo, though I agree, there are some crimes where the convicted person does not deserve to breathe the same air as us.
