Politically yes. Can you point to a Constitutional requirement for that claim?

The Constitution commands that the President ``shall'' nominate Supreme Court Justices.

Article VI of the Constitution provides that ``the Senators and Representatives . . . shall be bound . . . to support this Constitution.''

I couldn't find the "dying wish" clause though.
