The protection afforded by a patent is determined by the scope of the claims.
If the claims are suficiently generic (broad) they can be difficult to circumvent.
The limit of the claims is determined by the prior art and the nature of the invention.
A fundamental advance in technology should be able to justify very broad claims, whereas a minor improvement would only justify narow claims.
