What I find interesting is that KB decided to maul AJM at time of weakness and vulnerability when he clearly knew AJM management were seeking to raise capital and was at an advanced stage. Rather than reaching out he choose to attack, take advantage? Why- is the Posco deal not going ahead?

Was he legally entitled to approach note holders, using commercially confidential information when AJM
was trading as a going concern ?Where note holders allowed to open up discussions with a competitor when business was trading as a going concern and a waiver in place ? The note holders in my opinion have damaged AJM business interests, and their negligence in speaking with a competitor whilst AJM ought to be trading as going concern has caused a serious breach of confidentially. We are about to find out.

Should KB not have approached the owners of the company that was trading (at that point) as a going concern ? What damage has he caused AJM by the misuse of commercially sensitive information? Did he encourage note holders to tip AJM into administration by offering an incentive? How will he reimburse AJM?
