I think the answer is simple, build the shit out of the tech as fast as possible, make it unapproachable (in terms of level of effort) by all except the absolute biggest software houses.
A side product of this is having no money left in the bank for CA lawyers to get their greasy mitts on (suddenly justice is not reward enough).
At the end of this phase of trials, outcomes and appeals, GSW has a product that prints money but is fundamentally bankrupt. They are then bought out by a consortium ......
