Whether the market went up or down, the administrator sought advice from a Judge who said that the netting off date was 16th October or the day after the Default Notice was received. This was clearly not very popular but he may have had reasons for making such a ruling.
March 27th may have been introduced somehow, not entirely sure how yet, to make the netting off in line with common sense and public expectation, but it is presently not lawful as a netting off date.
It is essentially an olive branch so that people can at least get 35-40c as at March, rather than being at a net position < 35c as at 16th Oct. Even worse, they could be deep in the red, in which case they may be asked to pay up as per the Chrissie cards sent by Delloitte.
