There is one KEY issue in my mind which DEMANDS an answer :

Where was it ever disclosed to shareholders that there was in existence a 20 mill secured charge over CMR assets in favour of HNC ??? Thats the number being suggested atm.

And if it WAS some kinda cross-security say, at time of JV, then WHERE IS CMR's contra charge to HNC that HNC, by their action on eve of CMR scheduled EGM, actually INDUCED this state of piracy by TRIGGERING CMR's calling in of the VA ? Their action actually elevated them from having their debt equitised to abt 15% equity in CMR, to in fact total control over ALL CMR assets without further "cost"?

And since there aint no CMR LEFT to be able to make this contra charge, then WHO on CMR shareholders' behalf is able to ??? Shouldnt FH be doing so ... or has their ability to do so been curtailed by HNC calling in EY (R+M)? If so, isnt that FURTHER INDUCEMENT ... coincidental or otherwise ... and otherwise possibly labelled "piracy" ???

THIS is a key point for oz REGULATORS to pursue IMO ... cos it looks like a poss blatant abuse of existing Oz corporate law and they MUST BE SMILING ALL THE WAY TO THE BANK !!!

Should not the REGULATORS call them on such a poss legal point ?

Should not the FED GOVERNMENT ask the Qs about such possibilities and INTERVENE until the REGULATORS are able to clarify such a poss ?

Come on bros, NATIONAL POLICY and NATIONAL REGULATORY CREDIBILITY is at stake here ... who is going to ask the right Qs ???

Lets hope they are being asked ...
