Another catch 22. Those holding short positions relying on the 36c subscription price to cover.
If the acquisition does not go ahead shorts currently accepting the risk of a further increasing share price maybe caught with there pants down forced to cover at a much higher price.
If the acquisition happens Shorts would also have to be holding shares aswell to be eligible for the 36c subscription and only allocated a percentage of current holdings.
