In technical terms where a patent is involved, BRN has one and also a TM, depending upon the life span of the patent (the date it formally expires)
Others will try to replicate if it is at all possible, should it go onto the market within that time frame of a legally binding PATENT it WILL be pulled off the market at massive costs to whomever has overstepped the mark. (this will transpire very quickly and swiftly without any general public awareness)
example Look at PFIZER with their big hard on. VIAGRA
Both Patents and TM’s , should never be underestimated.
