If you're dealing with China you can write take or pay and penalties in the contract and they mean nothing.... Its not worth the paper it's written on in their eyes, which is why it's all about the relationship not the contract.
I know it's not how we ( Westerns) operate, but it's that old golden rule " he with the gold makes the rules" .... I suppose though you could say we have the new whit gold
