    again who would the class action be against.
    Smyth was the one who mislead shareholders.

    so would the claim be against him personally, or again CVI the company.
    if the former fine, as long as it is a no win no pay situation.

    If it is against CVI the company then in effect would be against present shareholders.

    And I have experience with MBC, none good.
