Obviously, it depends what happens in the next week or two, and legal advice would need to be sought again.
Let's see if ASIC step in after seeing 5 resignations from the Board, advisory board and company sec in one week - with something obviously wrong.
None of us chatting here are lawyers, so we would need to seek advice on whether our case was against Smyth for misleading, or against the whole company for permitting it to go unhindered.
The whole board can be held responsible, and that is what they have insurance for. It's to protect directors from this sort of action.
Hopefully Smyth will be dealt with separately too, but we are only speculating, so let's just wait and watch for a while.
