I am not a lawyer but my experience here in Australia is that there is a process of DISCOVERY before the hearing proceeds ie all parties have to put all of their cards on the table and exchange them with the other parties to the action prior to the hearing --you can't hold your aces in reserve AND sring a surprise from left field. It seems to me , the process that we are involved in is the same --recall the mention of an exchange of affadavits between the parties recently.LorentzAngula provided their recent views after they were privy to Amakutuwa's documents so I place some faith in the reiteration of their earlier comments viz his claim has no basis in FACT or LAW.
Rooster , no doubt the name HIGH Court implies that it is a senior court -- but my understanding is that the Supreme Court is the higher/highest court in Namibia -- opposite to Australia where the High court is the highest judicial body.
