from memory there were questions from the floor at a past AGM, asking when would holders get an opportunity for a rights issue etc. the 95c issue was created, i believe, for that purpose, and as you highlighted leinad, as it wasnt beneficial to holders, its takeup was low.

so lange could argue in the future that rights issues have been done, some successful, some not, but as they have delivered as requested, they arent required now.

another point - its quite possible this money was needed quite quickly for whatever news accompanies the raising, and hence its done as a placement, rather then a rights issue. lange has said in the past that NMS are not a bank, and so excess funds wont likely be sought.

i remain comfortable with such a decision.
