You are asking good questions and I can only suggest answers. It is not clear whether the anchor point is rigid or pivoting. If the frame was free to rotate on a vertical axis I think it would be self correcting and would turn broad side on to the wave (the desired position). That is fine if the waves are nice simple sine waves. If there is dramatic turbulence the frame is supposed to lie flat on the seabed but the mechanism for doing this is not described. Composite materials normally have a degree of flexibility (resilience) and this may save destruction in minor twisting effects. Remember it is supposed to move with the water (as it flaps) rather than resisting it.
With any of the wave devices there isn't much discussion on their storm handling capabilities. I guess they don't know precisely the extreme situations to be encountered and it may be a formidable cost to design for the 1000 year storm. Other anomalies might be an off course ship hitting it but that might be another lie-down-flat situation. How about trawl nets of a fishing boat trying to sweep the sea floor clean of fish? They lose their nets!
