That is the precise problem where are the boundaries...consider tall man get paid more than short, attractive women have more choice in their mates, men can run faster than women, aboroiginals have better eyesight...many examples of these differences which could be deemed discrimantory
I think the issue it seems to have gone a bit far one way on the boundaries
