If CG's are undistributed you sure WILL have to pay CGT. That was in part what that Federal Court Judgemetn was about. It's this complicated concept of "Present Entitlement". That is, if you are presently entitled to the Income of Capital Gain, the ultimate beneficiary pays the corresponding tax irrespective of whether you ACTUALLY RECEIVE all, none or some of the income.
