    If this is what it is all about, the question has to be why would Nearmap openly recognise Eagleview's patents and avoid work that may infringe on those patents, yet proceed with other work that would infringe on those patents? It sounds to me that Nearmap were aware of what would be considered an infringement of Eagleview's patents.
