Re Q1 - it is isn't 63 days wait, that is a cumulative total at that status. Maybe send David an email and ask him why he hasn't responded to the second request for more information.
Re Q2 - BPH has over $10M in the bank. In the unlikely event PEP11 didn't proceed, it would up to the Directors to deploy this as they see fit.
A lot of posters report on here that David is quite approachable so maybe you should push on with your quest and contact him directly by phone or email.
Perhaps you should update your sentiment too, I don't think it aligns with your comments or actions.
