Yes, no reason why other industry players cannot purchase a non-exclusive license from 4DS but keep in mind that 4DS under the JDA is “only” obligated to honour the sale of a 20 year non-exclusive license to Western Digital.

In the event, say one of Western Digital’s competitors launch an acquisition of 4DS Memory, 4DS in this case will be obligated under the JDA to notify Western Digital before the commercial transaction is ratified, allowing Western Digital to (a) counter offer or (b) purchase the 20 year non-exclusive license from 4DS.
