    Insider trading is defined in Division 3 of Part 7.10 in section 1043A of the Corporations Act. In general terms, a person who is in possession of material information which is not generally available cannot trade in the financial products which the information would affect. Examples of insider trading are:

    Trading on corporate information - a person is aware of material information (e.g. takeovers, profit results, changes in forecasts) relating to a company that has not yet become public information and trades on the basis of the inside information;
    Front-running - a person, who is aware of a large order in a stock which is likely to have price impact, trades in that stock or a derivative before the large order is executed and then exits that position during or following execution of that order.
    ASX Markets Supervision Surveillance Unit monitors ASX markets for possible insider trading which involves monitoring company announcements and media articles.

    Following the release of significant, material announcements, the ASX Markets Supervision Surveillance Unit will, as a matter of course, review trading in the stock and any derivatives (including ASX exchange traded options and SFE CFDs) that occurred prior to the announcement.

    ASX Markets Supervision also monitors its markets for possible continuous disclosure issues. If unexplained price or volume movements occur, ASX if necessary will issue the relevant company with a price query. If the company has an announcement to make, that will inform the market and minimise any further potential insider trading.

    If the Surveillance Unit finds a pattern of trading which raises the possibility of insider trading, further enquiries are made of the relevant brokers and details of their clients obtained. Should there be sufficient information suggesting that insider trading may have occurred, the matter is referred to ASIC for further consideration or investigation. Unlike market manipulation, once referred to ASIC ASX does not further investigate insider trading.
