There is no evidence of Western Digital and 4DS jointly creating / owning any patents under the JDA which means all patents 100% owned by4DS will not be subject to a royalty free basis.

"All granted patents and applications are 100% owned by 4DS having been developed in-house and are free from any royalty and or licensing obligations".

Below is a list of all Patents that I could find (28/30 with an additional two pending) all 100% owned by 4DS.



4DS Memory have indicated that they are not looking to commercialise an exclusive or non exclusive license.
There will be no lower fees or discounts in the event Western Digital seek to purchase the 20 year non Exclusive License.

Its highly unlikely 4DS will license the technology to Western Digital or anyone else as it's been formally stated by 4DS that they will strategically seek to be acquired by a memory maker or memory buyer.
