i have opted to exit today,

Before we were painted blue sky, with the plaintiff haveing no case in fact or law.

right or wrong, one judge disagrees.

So, evidently, there is a basis for his claim, which has blind sided our lawyers pov.

Were our lawyers always going to tell us "we have a good chance of success"??

Where did the market get mis-represented on the perceived risk??

It's concerning, that the judge was able to find, a logic, in law, or fact,,,to what was told to us, was not.

So, lets put the shoe on the other foot.

Lets poe that, there is merrit, and the appeal, against the same facts...

The company needs to spell out the point of law, or fact, that has been sided against us.

How can we, based on one or two line statements, of "trust us, our lawyers said.." make any assessment of the risk?

I think, while we have come off bottom today, this will drag out, and i have decided to what is now significant risk, to trade only, and expect that in the delays of the next weeks periods, this will trend lower.

Why, what, is going to make it trend higher??

until this cloud clears, who could trust the announced assesment by the company of this risk?

It is likely that they are only passing on what their lawyer told them, but something is missing.

Black and white??, many shades of grey, and any grey suit will mean an appeal failure as well.

Disapointed, moving funds to PEN, and NGM.

I have placed a lowly order, to where i think the market will treat this.

The bounce off intra lows, i think is just a tad too optimistic, and coupled with a due correction to the overall market, a dangerous place to hold.
