Despite his concerns over the “Bold Flush” race, Bailey did not listen to the audiotapes of
Gallagher’s activity on that day, nor did he ensure that Betting Supervisor Reg O’Toole did so.
Had he done so, he would, of course, have heard the phone call that we now know to have
been between Gallagher and Sigalla, which should have set Bailey on a chain of inquiry, or at
least given him reason to confront Gallagher squarely about his concerns.


Of all the races of interest to the Inquiry, this one drew the most public attention. It was the race in
which Andrew Sigalla won $250 000 on a $10 000 “top fluc” bet with Harry Barrett. Sigalla was a
known business associate of Gallagher, and had also been identified as one of the people who placed
bets on Gallagher’s behalf.
Inquiry investigations revealed that there had been a total of 14 calls, or attempted calls, between
persons using services registered to Gallagher and Sigalla on the day in question.
