Suing Toll will however lead to a lengthy court battle, of which likely be dismissed in Toll's favour, and costs being awarded to Toll. It would lead to management not placing their focus where it is needed, and extensive court costs. Toll would simply say that they do not have the resources to deliver (which is likely true), case dismissed. Even if we are successful, how does KLL profit from this????? Sure, they couldn't deliver on the contract, so it was terminated - simple as that Kimu.

The best course of action is NOT to attempt to sue Toll, as can be seen from above. Toll clearly can't/ do not want to provide their services, so let's move on to someone who can. The best course of option is to select another provider and get this SOP on the move.
