While I can appreciate that you would like to think all government officials act morally and ethically at all times, it is just plain true that sometimes they do not. In this case against Main, the judge concluded that "Mr Main acted in reckless disregard of a right which Mr Donoghue had at least to claim important common law privilege". It then goes on to say that "His Honour concluded that the Commissioner's process of assessment was affected by conscious maladministration."

It is safe to conclude that it is just possible that regarding JK, injustice has been done - especially since the commissioner has not provided JK with the same kind of relief given ordinarily for reverse takeovers. Imagine the effect this will have on future reverse takeovers here in Australia.
