I see how it may seem that way, but in reality those negotiations shouldn't preclude a simple extension of the existing agreement.
It is not typical to let agreements lapse if something bigger is in the works: in most settings, that would send a negative signal between the negotiating parties, not to mention shareholders in this instance. On the flip side, extending the agreement sends exactly the signal you are alluding to being possibly appropriate in this situation: we want everyone we excited with our announcement one year ago to know this is being renewed (which strongly hints at something in the works).
