If as some poster are saying she was blind drunk and unconcious then I would suggest she probably could not have willingly agreed.
In any case I am sure there would be previous cases before courts in which consent was not given. There are also historic court cases in which a man has been convicted because the woman withdrew consent during the original consensual act.
